CHA Issue-Based Forum: An Act Concerning Intimate Examinations

This CHA Issue-based Forum will review changes recently made to Connecticut’s statutory mandates for obtaining a patient’s informed consent that apply to hospitals and surgical facilities.  Section 1 of Public Act 22-33, An Act Concerning Intimate Examinations, Continuing Medical Education in Screening for Endometriosis and the Effects of Systemic Racism, Bias, Racial Disparities, and Experiences of Transgender and Treatment, Gender Diverse Persons on Patient Diagnosis, Care and the Establishment of an Endometriosis Data and Biorepository Program, and the Breast and Cervical Cancer Early Detection and Treatment Referral Program, clarifies the requirements for obtaining informed consent from patients before performing an “intimate exam” including when a patient will be under deep sedation or general anesthesia, or is unconscious.  There are several nuances and exclusions in the law that must be considered when implementing the new requirements, some of which may necessitate updates to current policies and procedures that address informed consent.
